General Terms and Conditions

1. Scope & provider

These General Terms and Conditions (GTC) apply to the use of the “profilo” service (the “Service”), operated by Merlin Kreuzkam, c/o Online-Impressum.de #5433, Europaring 90, 53757 Sankt Augustin, Germany (“we” / the “provider”). By registering or using the Service you accept these GTC.

2. Description of services

profilo lets you create, edit and publish a personal profile page (builder/bento grid). There is a free plan as well as paid premium features. The specific scope of features follows from the description within the Service as updated from time to time. During the test phase, features may change or be temporarily unavailable.

3. Registration & conclusion of contract

An account (email + password) is required to use the Service. The information provided must be truthful; login credentials must be kept confidential. The contract is concluded upon successful registration. The privacy policy must be accepted upon registration.

4. User obligations & prohibited content

You are responsible for the content you publish. The following are prohibited in particular:

• unlawful, abusive, discriminatory, youth-endangering or violence-glorifying content;
• the infringement of third-party rights (copyright, trademark, personality rights);
• spam, malware, phishing or misleading/fraudulent content;
• technical abuse (circumventing limits, automated mass use, overloading).

In the event of violations, we may remove content and suspend or delete the account.

You indemnify us against justified third-party claims arising from the content you publish or from a breach of these obligations, and you reimburse us for the reasonable costs of a necessary legal defense. This does not apply where you are not responsible for the breach.

5. Content & rights

You retain the rights to your content. You grant us the simple right, necessary for providing the Service, to store your content and — for published profiles — to display it publicly. You warrant that you hold the necessary rights.

6. Availability

We strive for high availability but do not owe it at 100 %. Maintenance, faults or force majeure may lead to interruptions. During the test phase there is no claim to a particular availability or a particular scope of features.

7. Premium & remuneration

Premium features are subject to a charge; prices and billing follow from the pricing overview. Payment processing will in future be handled via a payment service provider (Stripe). During the test phase, premium features may be provided free of charge.

8. Term & termination

The free contract runs for an indefinite period and can be ended at any time by deleting the account. Paid subscriptions follow the chosen term and can be cancelled at the end of the respective period. The right to extraordinary termination remains unaffected.

9. Liability

We are liable without limitation for intent and gross negligence as well as for injury to life, body or health. In cases of simple negligence we are liable only for the breach of essential contractual obligations and limited to the foreseeable damage typical for the contract. For services provided free of charge (test phase/Free), liability is limited to intent and gross negligence. We assume no liability for user-generated content.

10. Changes to the GTC

We may amend these GTC with effect for the future where this is necessary and does not unreasonably disadvantage you. We will notify you of changes in an appropriate manner; if you do not object within the stated period, they are deemed accepted.

11. Final provisions

German law applies. Should individual provisions be invalid, the remainder of the contract remains effective. Mandatory consumer-protection provisions of the state of your habitual residence remain unaffected.
